2011/06/25 - The Right to Private Contract
In the case of R. v. Schmidt, 2010 ONCJ 9 the Justice of the Peace P. Kowarsky ruled that priviate agreement, i.e. contracts between knowledgeable, consenting adults who did not what the 'protection' of government agencies was lawful:
"Utilizing the Latin interpretive guide: inclusio unius est exclusio alterius it seems apparent that the specific inclusion of those terms in the definition was to clarify that the term “marketing” as used by the Legislature means commercial marketing within the general public, and excludes a small group of people who have come together by private agreement, such as the cow share program established by the defendant, for the purpose of obtaining raw milk products from him, by buying shared ownership in his cows for the duration of the milking life of the cows;"
The Latin translation reads, "The inclusion of one is to the exclusion of others." as was used to clarify the statute definition for 'person' as found in the Health Protection and Promotion Act where it reads:
“person” includes a board of health, a municipality and any other corporation
I'll blog more on this word 'includes' but suffice it to say that it is a term specifically used to confuse even those of our honourable courts.
This case, under appeal, upholds the right of the individual to enter into private contract and enjoy a freedom outside of the confines of a statute.
